Creditor phone calls at work are the last thing any consumer wants. Congress understood this and included protection against such activity in the FDCPA. Section 805 of the Fair Debt Collection Practices Act prohibits debt collectors from calling the consumer: "at the consumer's place of employment if the debt collector knows or has reason to know that the consumer's employer prohibits the consumer from receiving such calls."15 U.S.C. Section 1692c(a)(3).

Stopping the phone calls at work is as simple as informing the debt collection company that you are not allowed to receive calls at work. Unlike a Cease and Desist letter, you do not have to inform the collector of this in writing. A verbal acknowledgement is all that is required. If the collector calls you again at work, you may have a claim against the debt collector for the violation of the rights afforded to you through the FDCPA. It is important to remember that you need to tell the collector that you cannot receive calls at work. Telling a collector that "now is not a good time" or "I cannot talk right now" is not enough.

Collection phone calls to your family and friends can be a complicated topic to understand. Collection agencies are allowed to contact other (third) parties to obtain location information about you. However, they are not allowed to inform the other person that they are a collection company or that you owe anyone a debt.

What the Collection Company IS Allowed to Say:

  • The call is regarding a personal matter
  • They call is an attempt to locate you
  • What is the best phone number or address to reach you at?

What the Collection Company IS NOT Allowed to Say:

  • The call is an attempt to collect a debt
  • They are a debt collection company (Including giving their name if the name of the collector refers to debt collection)
  • You owe them money
  • Debt Collectors are also not allowed contact a third party multiple times unless they believe the information they received was erroneous or has changed. This means that they cannot start calling your mother-in-law two times a day in an "attempt" to reach you.t
